Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The case originates in a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was held in federal custody.
In her decision, the judge pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The legal proceedings center on conflicting claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
Terms of Freedom
The judge, who was hearing his petition to removal in a Maryland district court, ruled that he must now adhere to the terms of his bond from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
This ruling represents a significant development in a complicated legal battle featuring allegations of mistaken imprisonment and contested gang associations.
